We do not sell, rent, or share your personal data with third parties for marketing purposes. Data may be shared with:
- Technical service providers (hosting, CDN) operating within the EU/EEA
- Legal authorities when required by German law or court order
No data is transferred outside the EU/EEA without adequate safeguards as defined in Chapter V of the GDPR.

Refund Policy
1. Service Commencement
Work begins upon receipt of the initial payment milestone as defined in the project proposal. Each service engagement has clearly defined phases with specific deliverables and acceptance criteria as outlined in our service descriptions.
2. Milestone-Based Refund Structure
Refunds are calculated based on completed project milestones in accordance with German commercial law:
- Before Phase 1 Completion: Full refund minus 15% administrative fee to cover preliminary analysis and planning work already completed
- After Phase 1, Before Phase 2: 50% refund of remaining balance, reflecting completed architecture and analysis deliverables
- After Phase 2 Completion: No refund available; final phase proceeds to delivery with full commitment
3. Refund Request Process
Refund requests must be submitted in writing to [email protected] within 14 days of the milestone in question. Requests are reviewed within 5 business days, and you will receive a written response detailing the refund calculation and timeline.
4. Non-Refundable Items
- Third-party software licenses already procured for the project
- Domain registration and renewal fees
- Completed design work that has been formally approved by the client
- Server infrastructure costs already incurred
5. Dispute Resolution
Any disputes arising from this refund policy will first be addressed through direct written communication. If unresolved within 30 days, disputes will be submitted to mediation through the Berlin Chamber of Commerce (IHK Berlin). If mediation fails, disputes shall be resolved in the courts of Berlin, Germany, in accordance with German commercial law.
Terms of Service
1. Acceptance of Terms
By engaging north visual current services, you (the "Client") agree to these Terms of Service. These terms constitute a legally binding agreement between the Client and north visual current (the "Provider"), registered at Sportfliegerstraße 5, 12487 Berlin, Germany.
2. Scope of Services
Services are defined in individual project proposals and statements of work (SOW). Any modifications to the scope require written agreement from both parties via email or signed amendment, and may affect pricing, timelines, and deliverables. The Provider reserves the right to adjust timelines for force majeure events.
3. Intellectual Property
Upon full payment of all invoiced amounts, the Client receives a perpetual, non-exclusive, worldwide license to use all deliverables including source code, design files, and documentation. The Provider retains the right to display work in portfolios, case studies, and marketing materials unless otherwise agreed in writing.
4. Confidentiality
Both parties agree to maintain strict confidentiality of proprietary information, trade secrets, and business strategies shared during the engagement. This obligation survives termination of the agreement for a period of 24 months and is governed by German trade secret law (GeschGehG).
5. Limitation of Liability
The Provider's total aggregate liability under any engagement shall not exceed the total fees paid by the Client under the specific project agreement. The Provider shall not be liable for indirect, consequential, incidental, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
6. Termination
Either party may terminate the agreement with 14 days written notice via email. Upon termination, the Client pays for all work completed and accepted up to the termination date. All work product delivered prior to termination is compensated in full. Post-termination support is available for 30 days at standard hourly rates.
7. Governing Law & Jurisdiction
These Terms are governed exclusively by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Berlin, Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
